A lawsuit has been filed by Bernardo Cruz (“Plaintiff”), against American Rugby Investments, LLC dba San Diego Legion (“Defendant”).This is not a lawsuit against you, and you are not being sued. Plaintiff alleges that Defendant violated California’s Unruh Civil Rights Act and Gender Tax Repeal Act of 1995 and asserts other legal claims relating to Defendant offering and providing a “Ladies Day Out” ticket package that included a discounted general admission ticket and commemorative SD Legion pinto class, for the San Diego Legion rugby match that occurred on February 23, 2020. Plaintiff alleges that male and/or non-binary persons were excluded from the ticket package solely on the basis of sex, gender, and/or gender-identity. Defendant denies these allegations or engaging in any wrongdoing whatsoever and further contends it fully complied with all applicable laws. The Court has not decided whether Plaintiff or Defendant is right, and it has not decided the merits of Plaintiff’s claims or Defendant’s defenses.

You may have received notice because Plaintiff wants Defendant to provide your name and email address to Plaintiff’s attorneys as part of Plaintiff’s investigation of the claims against Defendant. You have the right to opt out of the disclosure of your name and email address to Plaintiff’s attorneys. Plaintiff has brought his lawsuit as a potential class action. He seeks to represent other persons who attended the February 23, 2020, event who may be similarly situated. The potential class is defined as: “All male and/or non-binary persons who purchased an admission ticket (not Season Tickets or Comped Tickets) to the San Diego Legion match that occurred on February 23, 2020, but did not receive the discounted general admission ticket and/or San Diego Legion commemorative pint glass offered and/or provided in connection with the ‘Ladies Day Out’ ticket package.”

Plaintiff asserts the following legal claims in the lawsuit: (1) Violation of Civil Code § 51 – The Unruh Civil Rights Act; (2) Violation of Civil Code § 51.5; (3) Violation of Civil Code § 51.6 – The Gender Tax Repeal Act of 1995; and (4) Negligence.

Purpose of the Notice

Both sides are investigating the facts of this case. The purpose of the Notice is to inform you that as part of its investigation Plaintiff has made a request for your name and email address. The information will be provided to Plaintiff’s attorneys, not Plaintiff himself. The Court has not required the disclosure of your name or email address and has neither approved nor disapproved the Notice.

You have the right to opt out of the disclosure of your name and email address to Plaintiff’s attorney. If you do not want your name and email address released, you must click here to complete and submit your opt-out request through this website no later than December 19, 2025. If you do not complete and submit your opt-out request on or before December 19, 2025, your name and email address will be provided to Plaintiff’s attorneys.
